Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Proteas platform (the "Service") operated by TSALAMAGKAKIS GEORGIOS CHRISTOS PETROS ("we", "us", or "our"), established in Greece.

By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

Proteas is a B2B SaaS tool that enables merchants to perform bulk updates to customer subscriptions on connected platforms (Recharge, Skio, Loop, Stay, and similar) based on Klaviyo list and segment membership.

2. Accounts and Access

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately at gc@theartofecomm.com if you suspect unauthorised access to your account.
  • You may invite team members to your organisation. You are responsible for their use of the Service under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorised access to other organisations' data
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to process data you do not have the legal right to process
  • Circumvent any rate limits, security controls, or access restrictions

4. Your Data and API Credentials

You retain ownership of all data you bring into the Service, including API credentials and subscriber data retrieved from connected platforms. By using the Service, you grant us a limited licence to process that data solely to provide the Service on your behalf.

You are responsible for ensuring that your use of connected third-party platforms (Klaviyo, Recharge, Skio, etc.) complies with their respective terms of service.

5. Subscription Changes and Irreversibility

The Service applies bulk changes to live subscription records on connected platforms. You are solely responsible for reviewing batch contents before approving execution. We strongly recommend enabling the "Requires approval" setting on all rules.

We are not liable for unintended changes resulting from rules or batches you configure and approve.

6. Billing and Payment

Access to the Service is subject to a commercial arrangement agreed separately between you and us. Invoicing is handled outside the platform. Failure to settle invoices may result in suspension of access.

7. Availability and Support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided "as is". We will make reasonable efforts to resolve issues reported to gc@theartofecomm.com in a timely manner.

8. Intellectual Property

All intellectual property rights in the Service — including software, design, and documentation — are owned by or licensed to us. These Terms do not grant you any rights in the Service other than the limited right to use it as described here.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
  • Our total liability to you for any claim arising out of or relating to the Service shall not exceed the fees paid by you in the three months preceding the claim.

Nothing in these Terms limits liability that cannot be excluded under Greek or EU law.

10. Termination

Either party may terminate the commercial arrangement with reasonable notice. Upon termination, your access to the Service will be revoked. Batch history and organisation data will be retained for a reasonable period before deletion, unless you request earlier deletion.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Greece. Any disputes shall be subject to the exclusive jurisdiction of the courts of Greece.

12. Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes by email or in-app notification. Continued use of the Service after the updated Terms take effect constitutes your acceptance.
